Welcome to Jewelclues.com. Jewelclues LLC (“Jewelclues”, “we”, “us”, or “our”) operates this website and provides products and services to you when you visit or shop with us. By accessing or using our Services, you agree to be bound by these Terms of Service.

Electronic Acceptance of Terms

By clicking “SUBMIT”, “PLACE ORDER”, “PAY NOW”, “SECURE CHECKOUT”, or similar actions, you agree that such actions constitute a legally binding electronic signature under the Electronic Signatures in Global and National Commerce Act (E-Sign Act).

Service Availability and Changes

We may modify, suspend, or discontinue any part of the Services at any time without notice. Continued use of the Services constitutes acceptance of such changes.

Privacy

Your use of the Services is also governed by our Privacy Policy.

Electronic Communications

You consent to receive electronic communications from us, including emails, SMS, and notifications. These satisfy any legal requirement for written communication.

Account Responsibility

You are responsible for maintaining your account credentials and all activity under your account. We reserve the right to refuse service, terminate accounts, or cancel orders at our discretion.

Orders, Pricing, and Payment

All orders are subject to acceptance by Jewelclues. Receipt of an order confirmation does not constitute acceptance. An order is considered accepted only upon shipment.

Prices are subject to change without notice. We reserve the right to correct pricing errors and cancel or adjust orders placed under incorrect pricing.

Payment is authorized at checkout and may be captured at the time of order placement, subject to order acceptance and fulfillment.

By placing an order, you authorize Jewelclues to charge your selected payment method for the full order amount, including applicable taxes and shipping fees.

Sales Tax

Sales tax is charged only on eligible taxable orders shipped within New Jersey and is applied in accordance with applicable New Jersey state and local tax laws.

Risk of Loss and Shipping

All purchases are made pursuant to a shipment contract. Risk of loss transfers to you upon delivery of the order to the carrier.

Returns and Refunds

Returns, refunds, and eligibility are governed by our Return Policy and Refund Policy.

Product Information & Expectation Framework

We strive to ensure accuracy in all product descriptions, images, specifications, and related details; however, we do not guarantee that all content is entirely error-free.

Product images are provided for illustrative purposes only. Variations in color, texture, lighting, or appearance may occur and are not considered defects.

Certain products are made-to-order or handcrafted and may include natural variations due to artisanal production methods and material batch differences.

Customers are responsible for selecting appropriate sizes and providing accurate measurements where required. Size guidance is provided for reference only and does not guarantee fit.

Made-to-Order Production, Chargebacks & Production Disruption

Jewelclues products are made-to-order and production resources including materials, labor, and manufacturing capacity may be allocated specifically to each order upon purchase.

If a payment dispute, chargeback, or payment reversal is initiated at any stage prior to shipment, Jewelclues reserves the right to immediately suspend or cancel production pending resolution of the dispute.

If a chargeback or payment reversal results in a permanent reversal of funds, the corresponding order shall be deemed permanently cancelled and the contractual relationship between Jewelclues and the customer shall be terminated.

Due to the time-sensitive and customized nature of production, any disruption caused by a payment dispute or chargeback results in the consumption, loss, or reallocation of materials, labor, and production capacity within standard production cycles. Such production work is considered non-recoverable.

Jewelclues shall have no obligation to complete, resume, or reproduce any order following a chargeback or payment reversal. Any future purchase shall constitute a separate order subject to then-current pricing, availability, policies, and production conditions.

If payment is reinstated following dispute resolution, such reinstatement does not restore or reactivate the original order, as the original production cycle is permanently terminated due to disruption.

This policy is intended to operate in alignment with applicable card network rules governing made-to-order and custom goods transactions, including those of Visa, Mastercard, and American Express.

User Content

You may submit content provided it is lawful and does not violate third-party rights. By submitting content, you grant Jewelclues a worldwide, royalty-free license to use such content.

Prohibited Uses

You agree not to misuse the Services for unlawful activity, fraud, scraping, or infringement of intellectual property rights.

Indemnification

You agree to indemnify and hold harmless Jewelclues LLC from any claims arising from your use of the Services or violation of these Terms.

Disclaimer of Warranties

The Services are provided “as is” and “as available” without warranties of any kind.

Limitation of Liability

Jewelclues shall not be liable for any indirect or consequential damages arising from use of the Services or products purchased.

Dispute Resolution & Arbitration

Any dispute shall be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Arbitration shall be individual only and governed by the Federal Arbitration Act.

Chargebacks & Payment Disputes

You agree to contact Jewelclues directly before initiating any chargeback or payment dispute so we may attempt to resolve the issue internally.

We reserve the right to present order records, production allocation data, and communication history as evidence in any dispute process.

Intellectual Property

All content is owned or licensed by Jewelclues and may not be used without permission.

Governing Law

These Terms are governed by the laws of the State of New Jersey and applicable U.S. federal law.

Severability

If any provision is found unenforceable, the remaining provisions remain in effect.
